This is an important letter with important information that most likely WILL affect you. 

 

This last March the National Association of REALTORS® settled a Class Action Lawsuit for hundreds of millions of dollars based upon an argument that the traditional commission sharing was unfair to buyers. 

 

The result of this has significant ramifications in the processes for viewing and negotiating contracts for ANYONE who desires to buy a home and/or view homes. 

 

As of August 17th, as a part of this settlement and for the National Association of REALTORS® and the MLS to avoid future massive class action lawsuits, every agent that is a member of or has access to the MLS WILL BE REQUIRED TO HAVE A WRITTEN CONTRACT WHEREBY THE POTENTIAL HOME BUYER MUST SIGN AN AGREEMENT TO PAY THAT BUYER’s AGENT DIRECTLY—BEFORE SHOWING ANY PROPERTY. 

 

If agents violate this requirement they will be exposed to heavy fines and potentially a loss of the use of the MLS which would essentially put them out of business.

 

This IS the way business will be done for the foreseeable future and if you are looking to buy a home you will need to prep for this, which means that before you start looking at homes, you most likely will need to choose an agent or a team of agents to work with. 

 

I am writing you today because, if you were thinking about buying or selling, I want to let you know that I have put together an incredible bundle of services that I think have significant value, and I would be honored to interview for the job of your agent and show you how I can help you find the best house possible at the very best price possible. During the interview I would show you how I would accomplish the following things to make the home buying process seem as normal as it used to be by . . .

 

  1. 1. Working diligently to make sure the sellers or the other agents pay my fee and if I cannot arrange this, I will significantly reduce my fee.
  2. 2. Providing the Very Best Service in comparison with any competitive Real Estate Agent 
  3. 3. Giving you the ability to terminate the agreement, if you feel that it is not working out. 

     

 

By the way, if you did agree to allow me to “throw my hat in the ring” and interview for the job, if you did not choose me and went with someone else, I would never be upset with you. On the contrary, I would only be appreciative of you for the opportunity you gave me to “swing at the ball”.
